CITY COUNCIL MINUTES
FEBRUARY 10, 2009
The Council of the City of Fulton, Missouri, met in regular session and held one (1) Public Hearing on Tuesday, February 10, 2009, in the Council Chambers of City Hall located at 18 E. 4th Street. Present and presiding were Charles M. Latham, Mayor; William Johnson, Director of Administration; Carolyn L. Laswell, City Clerk; and Steve Myers, Chief of Police. The meeting was called to order by Mayor Latham at 7:30 p.m. Roll call was taken by the City Clerk and members of the council present were Benton; Bill; Digh; Gohring; Harris; Moore; Pautz; and West. Also present were Dean Buffington, Fire Chief; Kathy Holschlag, Chief Financial Officer; J. C. Miller, Solid Waste Manager; Clay Caswell, Parks & Recreation Director; Sherri Redmon, Human Resource Director; Matt Harline, Assistant to the Director of Administration; Darrell Dunlap, Superintendent of Utilities; Greg Hayes, City Engineer; Les Hudson, Planning & Protective; J. C. Miller, Solid Waste Manager; Lowe Cannell; Ashley West; Eric Qualls; Rick Shiverdecker; Katherine Cummins, reporter for The Fulton Sun; Jeremy Polston and Justin Dean, Audio/Video.
INVOCATION:
Invocation was given by Mayor Latham.
COMMENTS FROM VISITORS:
Mayor Latham asked if there was anyone present who wished to address the council that was not listed on tonight's agenda to please come to the podium and state their name, address and area of concern. There were none.
PUBLIC HEARING:
To consider the following tract of land for Annexation in to the City of Fulton.
The East 500.0 feet of the Southeast Quarter of Section Twenty-five (25), Township Forty-seven (47) North, Range Ten (10) West. Excepting that part deeded to the State of Missouri for highway purposes. Containing 36.66 Acres.
This hearing was declared open by Mayor Latham at 7:32 p.m.
There were three calls issued for anyone wishing to speak IN OPPOSITION of the matter being considered.
First call, is there anyone present who wishes to speak in opposition of this proposed annexation? There were none.
Second call, is there anyone present who wishes to speak in opposition of this proposed annexation? There were none.
Third and final call, is there anyone present who wishes to speak in opposition of this proposed annexation? There were none.
There will now be three calls issued for anyone wishing to speak IN FAVOR of the matter being considered.
First call, is there anyone present who wishes to speak in favor of this proposed annexation? There were none.
Second call, is there anyone present who wishes to speak in favor of this proposed annexation? There were none.
Third and final call, is there anyone present who wishes to speak in favor of this proposed annexation? There were none.
This Public Hearing was declared closed at 7:35 p.m.
SUBJECTS OF DISCUSSION:
a) Update on the SWAT Committee meeting.
Mayor Latham said this meeting was an organization meeting and was very pleased with the turnout of attendance. This committee will be meeting on the first and third Thursdays at 4:00 p.m.in the Executive Conference Room located in City Hall. As a result of this meeting, the members asked for firm numbers on the closure-postclosure costs of the landfill. The next meeting is scheduled for February 19th, 2009.
b) Update on the City Branding Committee meeting.
Councilman Harris said this committee was a focus group and it was very well attended. The purpose of this meeting was to obtain a feel emotionally on what type of brand would be best for Fulton. The committee is working on graphics and a color scheme.
c) Update on the plans for the City of Fulton observance of their 150 Anniversary.
Councilwoman Digh said the official observance and Declaration will be on Saturday, March 14th at 10:00 a.m. at City Hall. The Stamp Society will have a canceled stamp for this 150th anniversary celebration. There will also be special events at the Street Fair, Concert in the Park, and the Christmas Parade. Special lapel pins celebrating the 150th Anniversary have been ordered.
Barbara Huddleston, Historical Society, is putting together a pictorial history of the city.
RESOLUTIONS:
Resolution 3025 was presented and read by Councilman Bill.
Resolution 3035 - A Resolution Authorizing the Mayor, on behalf of the C.O.F., to sign all necessary documents to enter into an Interconnect Agreement with Panhandle Eastern Pipeline Company, LP., and establishing an effective date (Copy is included in the official Resolution Book).
Motion was offered by Councilman Bill and seconded by Councilman Harris to adopt Resolution 3035 at this council meeting. Motion carried with all eight members of the council voting in favor.
Resolution 3036 was presented and read by Councilman Pautz.
Resolution 3036 - A Resolution Authorizing the Director of Administration, on behalf of the City of Fulton, to sign a Petition to the County Circuit Court to add certain properties to the existing Fulton South Business 54 Transportation Development District (TDD) (Copy is included in the official Resolution Book).
Motion was offered by Councilman Pautz and seconded by Councilwoman Digh to adopt Resolution 3036 at this council meeting. Motion carried with all eight members of the council voting in favor.
ORDINANCES:
Bill No. 1264 was presented for first reading by Councilman Harris.
Bill No. 1264 - An Ordinance Incorporating certain territory into the corporate limits of the City of Fulton, establishing an initial zoning and an effective date.
Motion was offered by Councilman Harris and seconded by Councilman Moore to place Bill No. 1264 for second reading at the next regularly scheduled council meeting. Motion carried with all eight members of the council voting in favor.
Bill No. 1263 was presented for second reading by Councilman Benton.
Bill No. 1263 - An Ordinance Allowing the "Show Me Green Sales Tax Holiday" to apply to the local sales tax of the City of Fulton, Missouri, between April 19th and April 25th, 2009 (Copy is included in the official Ordinance Book).
Motion was offered by Councilman Benton and seconded by Councilman Bill to place Bill No. 1263 for third reading at this council meeting. Motion carried with all eight members of the council voting in favor.
Bill No. 1263 was presented for third reading by Councilman Benton.
Motion was offered by Councilman Benton and seconded by Councilman Pautz to place Bill No. 1263 for final passage at this council meeting. Motion carried with all eight members of the council voting in favor.
Roll call vote of members of the council was as follows: Bill, yes; Digh, yes; Gohring, yes; Harris, yes; Moore, yes; Pautz, yes; West, yes; and Benton, yes. Bill No. 1263 having received the affirmative vote of all eight members of the council was declared passed by the President of the council.
ANNOUNCEMENTS:
A reminder of the Fulton Area Development Corporation (FADC) Business Salute on Thursday, February 19th at Tucker Dining Hall on the campus of William Woods University. Anyone wishing to attend, please contact the city clerk at tonight's council meeting or no later than Friday, February 13th.
EXECUTIVE SESSION:
Mayor Latham said there was no need for an executive session at this council meeting.
ADJOURNMENT:
There being no further business to come before the council, motion was offered by Councilman Pautz and seconded by Councilman West to adjourn this meeting. Motion carried with all eight members of the council voting in favor and the meeting adjourned at 7:55 p.m.
