CITY COUNCIL MINUTES

MARCH 14, 2006

 

The Council of the City of Fulton, Missouri, met in regular session and held a Public Hearing on Tuesday, March 14, 2006, in the Council Chambers of City Hall located at 18 E. 4th Street.  Present and presiding were Robert W. Craghead, Mayor; William Johnson, Director of Administration; Cathleen Haymart, Deputy City Clerk; and Steve Myers, Chief of Police. The meeting was called to order by Mayor Craghead at 7:30 p.m.  In the absence of the City Clerk roll call was taken by the Deputy City Clerk and members of the council present were Benton, Bill, Chailland, Harris, McCall, Moore, Sands and Wilkinson.   Also present were Patrick Bonnot, Assistant to the Director of Administration; Les Hudson, Code Enforcement Officer; Sharon Cleveland, Purchasing Agent; Dean Buffington, Acting Fire Chief; Greg Hayes, City Engineer; Clay Caswell, Parks & Recreation Director; J. C. Miller, Solid Waste Director; Sherri Redmon, Human Resources Director, Darrell Dunlap, Superintendent of Utilities; Jane Hubbard, Chief Financial Officer; Matt Harline; Allison Gohring; Dick Keller; Derrick Dohmen; Mike West; Mary Harrison; Trent Willenburg; Kenny Willenburg; Mark Sommerhauser, reporter for THE FULTON SUN; Jeremy Polston and Justin Dean, audio/video.

 

INVOCATION:

 

Invocation was given by Mayor Craghead.

 

COMMENTS FROM VISITORS:

 

Mayor Craghead asked if there was anyone present who wished to address the council that was not listed on tonight's agenda to please come to the podium and state their name, address and area of concern.

 

Matt Harline with the Mid-Missouri Solid Waste Management District Region H, spoke thanking the city for their excellent cooperation in the past years.

 

He reported the tire collection is scheduled for April 8 at 9:00 a.m. to 3:00 p.m.  For the first time there will be a charge for this service.  The goal of this program is to clean up the existing piles of tires and not promote the development of new ones.

 

He also reported on a White Goods project whereby refrigerant would be removed from these items making them easier to dispose of.

 

There will also be an open grants call for requests of $5,000 or less.

 

SUBJECTS OF DISCUSSION:

 

a)   Summary of Work Session on the proposed Aquatic Center.

 

Mayor Craghead reported Clay Caswell presented a revised plan for the aquatic center that might be feasible.  The cost is proposed at 4.8 million.  The YMCA director spoke to the Council.  It was generally agreed to talk with the YMCA again in the next 10 days.

 

b)   Discussion on request of Westminster College to vacate Woodlawn Avenue.

 

Greg Hayes, City Engineer, spoke stating the city would retain utility rights.  This 24 foot easement will give fire access.

 

Motion was offered by Councilman Chailland and seconded by Councilman Moore to draw up an ordinance for the next council meeting abandoning this street.  Motion carried unanimously with all eight members voting in favor.

 

c)   Discussion of Natural Gas Rates.

 

Darrell Dunlap, Superintendent of Utilities reported we should be able to lower the gas rate to $9.45 per mcf on the April bill.

 

He distributed a graph showing the trend for gas prices going down.

 

Bill Johnson noted we are close to the rate we were at before the gas started going up and fluctuating.

 

Motion was offered by Councilman Benton and seconded by Councilman Bill to lower the gas rate to $9.45 per mcf for the April bill.  Motion carried unanimously with all eight members of the council voting in favor.

 

Darrell Dunlap reported 3 men and 2 trucks went to Monroe City to help restore power to the downtown lines that were destroyed by Sunday nights storm.

 

d)   Discussion on the request to vacate a portion of Cleveland right-of-way between Blackburn & Collier.

 

Greg Hayes stated the city would abandon the whole stretch.

 

The Mayor stated in the past the policy has been for the property to revert to the adjacent property owners.   The city could also declare the property surplus and sell it.  There is a party with property on Collier interested in buying this strip of land.

 

The Mayor asked the council to think about this.

 

RESOLUTIONS:

 

Resolution 2819 was presented and read by Councilman McCall.

 

     Resolution No. 2819 - A Resolution authorizing the Mayor, on behalf of the City of Fulton, to execute a Fixed Base Operator's Lease Agreement with James R. Moseley doing business as Skytek Corp. for services at Elton Hensley Memorial Airport.

 

Greg Hayes stated this contract was up at the first of the year.  The contract was left as is with a change in the effective date.  The insurance coverage is the same as required by Travis St. John.

 

Motion was offered by Councilman McCall and seconded by Councilman Harris to adopt Resolution 2819 at this council meeting.  Motion carried unanimously with all eight members present voting in favor.

 

Resolution 2820 was presented and read by Councilman Benton.

 

     Resolution No. 2820 - A Resolution authorizing the Mayor, on behalf of the City of Fulton, to execute a Work Agreement for Fulton Reception and Diagnostic Center Supervised Institutional Work Release Program with the Missouri Department of Corrections to provide an Offender Work Crew for services for the Solid Waste Department.

 

Motion was offered by Councilman Benton and seconded by Councilman Moore to adopt Resolution 2820 at this council meeting.  Motion carried unanimously with all eight members present voting in favor.

 

ORDINANCE:

 

Bill No. 1137 was read for the second time by Councilman Harris.

 

     Bill No. 1137 - An Ordinance Re-Classifying under the zoning ordinance certain land in the City of Fulton, Missouri, lying between 601 and 605 Cote Sans Dessein.

 

Motion was offered by Councilman Harris and seconded by Councilman Wilkinson to place Bill No. 1137 for third reading at this council meeting.  Motion carried unanimously with all eight members voting in favor.

 

Bill No. 1137 was read for the third time by Councilman Harris.

 

Motion was offered by Councilman Harris and seconded by Councilman Moore to place Resolution 1137 for final passage at this council meeting. Motion carried with all eight members of the council voting in favor.

 

Roll call vote of members of the council was as follows: Benton, yes; Bill, yes; Chailland, yes; Harris, yes; McCall, yes; Moore, yes; Sands, yes and Wilkinson, yes. Bill No. 1137 having received the affirmative vote all eight members of the council was declared passed by the President.

 

Councilman Harris asked when the downtown parking meters would be changed to 5 hour parking.

 

Greg Hayes stated he did not know when the company that does this for the city will be back in town but he will check on it.

 

Councilwoman Chailland thanked Patrick Bonnot for his work on the Adopt-a-Street program.

 

Councilman Bill expressed concerns regarding ordinances that are not being enforced.  We need to go through the Code Book at work sessions or a retreat.  Some of the ordinances are archaic.

 

Bill Johnson reported he spent the day with a developer that stated his research showed the population of Fulton at 14,000.

 

Councilman Moore thanked Matt Harline for his work.

 

APPOINTMENTS:

 

There were no appointments to be presented at this council meeting.

 

ANNOUNCEMENTS:

 

Mayor Craghead reminded everyone of the Mayor's Prayer breakfast on March 21 at 6:30 a.m.

 

He also reminded the council members because of the Kingdom of Callaway Supper the next council meeting was changed from March 28 to March 29.

 

The Mayor also announced the FADC banquet is Thursday night.

 

EXECUTIVE SESSION:

 

Mayor Craghead said there was no need for an executive session at this council meeting.

 

ADJOURNMENT:

 

There being no further business to come before the council, motion was offered by Councilman McCall and seconded by Councilwoman

 

Chailland to adjourn this meeting.  Motion carried with all eight members voting in favor, and the meeting adjourned at 8:00 p.m.
